REGULATIONS OF THE ONLINE STORE             www.wemi.pl

1. These Regulations define the rules for concluding sales contracts in the Wemi Online Store (hereinafter: Store).
2. The terms specified in the Regulations (hereinafter referred to as the Regulations) mean: 

Civil Code: Act of April 23, 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).  Code of Civil Procedure - Act of November 17, 1964 (Journal of Laws 1964, No. 43, item 296, as amended).
Consumer: a natural person performing an unrelated legal act
directly related to its business or professional activity.
Statute: these Regulations created on the basis of art. 8 section 3 of the Act of 10 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204), which specifies the rules for making purchases in the store.
Client:a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who places an Order in the Store.
Store (Online Store): website available at www.wemi.pl, where the Customer makes distance purchases.
Goods: product whose description is available in the Store.
Sales agreement: contract for the sale of Goods within the meaning of the Civil Code, concluded between the Wemi Store and the Customer via the Store's website.
Order: the Customer's declaration of will, which specifies the type and number of the Goods.


§ 1 General provisions
 

1. The owner of the Wemi Online Store is "Wemi Sp. z o. o. available at:
street Warsztatowa 7a, 33 - 100 Tarnów, who runs a business registered in the Central Economic Registration and Information (CEIDG), with NIP: 993-069-55-50, REGON: 525462381
2. You can contact the Online Store:


a) by mobile phone number 24 hours a day: 698435970, call cost per 1 minute according to the operator's tariff,
b) using e-mail: wemi.on.the.go@gmail.com
c) by correspondence: ul. Warsztatowa 7a, 33 – 100 Tarnów


3. The subject of the Store's activity is the sale of tourist products and accessories related to these products
4. The Seller completes orders in the territory of the Republic of Poland.
5. The sales contract between the Customer and the Wemi Online Store is concluded in Polish.
6. The Regulations are made available to the Service Recipient free of charge before concluding the contract, and - at his request - in a way that enables the acquisition, reproduction and recording of its content using the IT system used by the Service Recipient.
7. To use the Wemi Online Store, you need a computer with Internet access, which has e.g. Windows installed, an Internet Explorer browser in a version not older than 8.0 or Mozilla FireFox in version 3.0 or newer, or Chrome or Opera with support enabled. Java Script and cookies support with a minimum screen resolution of 1024 × 768 pixels, active e-mail address.


§ 2 Placing orders
 

1. Each product offered in the store comes from a legal source.
2. The prices of goods in the store are gross prices and are given in Polish zlotys.
3. The prices quoted include VAT and do not include shipping costs.
4. Orders can be placed via the Store, by phone or e-mail.
5. Orders via the Store can be placed 24 hours a day, 7 days a week all year round.
6. In order to conclude a Sales Agreement via the Store, you must register on its website www.wemi.pl, complete the form and accept the Regulations.
7. Then select the Goods in accordance with the messages displayed on the website.
8. The Customer selects the ordered Goods by adding them to the "Basket", provides the data necessary for shipping and issuing an invoice, selects the payment method and sends the Order to the Store.
9. After placing the Order, the Customer receives a message from the Store to the e-mail address provided: "Order from the Wemi online store". Upon receipt, the sales contract is concluded.


§ 3 Costs and delivery date


1. The shipment is sent to the address indicated in the Order form. The Store will inform the Customer immediately about an incorrectly completed order form, which prevents shipment or may delay it.
2. The shipment is delivered in accordance with the delivery option selected by the customer. Wemi declares that it is not responsible for untimely delivery of parcels by post office and other courier companies. When selecting the payment option "transfer" or "payment by card or online transfer", the time specified on the website should include the time for the funds to be credited to the store's bank account (usually 1-2 business days). 

3. Shipping costs are covered by the buyer. The amount of fees depends on the type of transport and payment method. The price list is available in the basket with the ordered goods - options, delivery methods.


§ 4 Payment methods
 

1. Each transaction is confirmed in accordance with the Customer's instructions with an invoice.
2. Payment for the ordered goods may be made on delivery (upon receipt of the goods), via the dotpay.pl electronic payment system or by transfer to the Store's bank account. PKO BP 02 1020 4955 0000 7602 0297 1844


§ 5 Withdrawal from the contract


1. A consumer who has concluded a distance contract may withdraw from it without giving reasons by submitting an appropriate declaration in writing within 14 days (Article 7(1) of the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws of 2012,
pos. 1225).
2. The fourteen-day period within which the consumer may withdraw from the contract is counted from the date of delivery of the item, and if the contract concerns the provision of a service - from the date of its conclusion.
3. In the event of withdrawal from the contract, the contract is considered void and the Consumer is released from any obligations. What the parties have provided is returned unchanged, unless the change was necessary within the scope of ordinary management.
4. In the event of withdrawal from the contract by the Consumer, the entrepreneur has the following rights:
the obligation to certify the return of the benefit in writing.
5. The return should be made immediately, no later than within 14 days.
6. The customer has the right to return the digital product until he starts using it. After using the product, the service will be fulfilled and the right to withdraw from the contract is lost.


§ 6 Complaint procedure
 

1. When submitting a complaint, please contact Wemi by phone or e-mail. You must provide your name and surname, send proof of purchase (invoice) and describe the subject of the complaint.
2. The complaint will be considered within 14 days from the date of its submission.
3. The complained product may be repaired or replaced with a new one. If this turns out to be impossible, the Customer will receive a refund in accordance with his instructions.


§ 7. Privacy policy and personal data protection
 

1. By accepting the regulations, the Customer agrees that the store owner will process his personal data in accordance with the Act of August 29, 1997 on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended). ), necessary for the service implementation process and marketing purposes. At the same time, the Customer has the right to view and correct his personal data.


§ 8. Final provisions
 

1. In matters not regulated in these Regulations, the following provisions shall apply:


1) Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws of 2012, item 1225),
2) Act of July 27, 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended), 
3) and the relevant provisions of the Civil Code.


2. Disputes arising from the application of these Regulations in connection with the implementation of contracts concluded between the Store and the Consumer will be resolved by common courts of general and alternating local jurisdiction in accordance with the provisions of the Code of Civil Procedure.
3. In relation to entrepreneurs, these disputes will be considered by the court having jurisdiction over the seat of the Online Store.
